2. DEFINITIONS

In this Agreement: “LAW” refers to Law No. 6502 on the Protection of Consumers; “REGULATION” refers to the Regulation on Distance Contracts; and “SERVICE” refers to activities such as tours, transfers, accommodations, or travel arrangements provided in exchange for a fee.

3. SUBJECT MATTER

This Agreement governs the rights and obligations of the parties regarding the sale and performance of the service ordered by the BUYER via the avengerstravel.com website owned by the SELLER, as described below with its characteristics and sales price, in accordance with the provisions of Law No. 6502 and the relevant Regulation.

4. SERVICE SUBJECT TO THE AGREEMENT AND PAYMENT INFORMATION

The type, content, duration, and sales price (including all taxes) of the service selected by the BUYER (Tour, Transfer, Accommodation, etc.) are as follows:

5. GENERAL PROVISIONS

5.1. The BUYER acknowledges that they have read and are aware of the preliminary information regarding the essential characteristics of the service subject to the contract, the sales price, the payment method, and the terms of performance on the avengerstravel.com website, and that they have provided the necessary confirmation electronically.

5.2. The SELLER is responsible for ensuring that the service subject to this contract is provided free of defects, in accordance with the specified characteristics, and, if applicable, accompanied by the relevant documentation.

5.3. The performance of the service is conditional upon the electronic approval of this Contract and the payment of the fee.

6. RIGHT OF WITHDRAWAL AND CANCELLATION CONDITIONS

6.1. The Consumer may not exercise the right of withdrawal in contracts related to the accommodation, transportation of goods, car rental, food and beverage supply, and the use of leisure time for entertainment or relaxation purposes in the service sector (Regulation Article 15/g).

6.2. However, specifically regarding the tours and services offered by the SELLER, cancellations made a certain period before the service start date (e.g., 48 hours) are subject to the refund policy outlined in the “Cancellation and Refund Terms” on the website.

7. CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

The right of withdrawal cannot be exercised in the following cases:

Custom tours prepared according to the consumer’s request or personal needs.

Accommodation, transportation, or entertainment services that must be provided on a specific date or during a specific period.

Services for which performance has already begun.

8. COMPETENT COURT

Any disputes arising from this contract, including complaints and objections, shall be submitted to the Consumer Arbitration Board or the Consumer Court located in the Buyer’s place of residence or where the service was performed.

9. ENFORCEMENT

The Buyer is deemed to have accepted all terms of this contract upon completing the reservation/order through the website and making the payment.
